What to Do Before Charges Are Filed

If you have been arrested or learned that you are under investigation, the steps you take before charges are filed can shape the trajectory of your entire case. Here is what you should do.

Step 1: Stop talking to law enforcement immediately. What you say to police, detectives, or investigators can be used against you. If you have already made statements, it is not too late to stop. You have the right to remain silent and to request an attorney before any further questioning. Exercise that right now. Do not try to explain your side, correct misunderstandings, or cooperate your way out of the situation. Even truthful statements can be taken out of context and used to build a case against you. Can a defense attorney actually prevent charges from being filed?

Yes. Between an arrest and the State Attorney’s filing decision, a defense attorney can contact the prosecutor’s office, present evidence, and advocate for the case to be declined. The State Attorney is not required to file charges on every arrest. Prosecutors evaluate the strength of the evidence, witness credibility, and the circumstances of the case before deciding whether to proceed. When a defense attorney presents compelling reasons not to file, the prosecutor may decline to prosecute, resulting in no charges and no criminal record.

How long does the State Attorney have to file charges after an arrest?

Florida procedure requires the State Attorney to make a charging decision within 30 days of arrest when the defendant is being held in custody, and a court can extend that period in limited circumstances. When a defendant has been released, the outer limit is set by the statute of limitations for the offense, which is much longer. In practice, the filing decision is often made much sooner, sometimes within days of the arrest. That is why contacting an attorney immediately after an arrest matters. The earlier pre-file advocacy begins, the more time there is to investigate, gather evidence, and present a case to the prosecutor.

Should I talk to police or detectives if I have not been charged yet?

No. You have the constitutional right to remain silent and to have an attorney present during any questioning.
