| Legal Standard – Downward Departure and Dual Diagnosis Under section 921.0026(2)(d), Florida Statutes, a judge may sentence below the lowest permissible sentence when a defendant requires specialized treatment for a mental disorder unrelated to substance abuse or addiction and is amenable to treatment. Critically, section 921.0026(3) provides that substance abuse or addiction – by itself – is never a valid basis for a downward departure. That is why dual diagnosis matters. There must be a mental health condition separate and apart from the substance abuse to support the mitigator. Where that separate diagnosis exists, both conditions can then be addressed together under a single treatment plan.
